I'm sure you didn't notice that Western legal systems have included an insanity defense for hundreds of years; it's hardly some new and novel concept.

They could say it. luckily for us just saying it isnt enough. severe mental illness is very difficult to fake.

Actually, it’s not just my opinion; all of ours are. There is one truth and reality alone that constrains it, not our opinions, so all of our opinions are flawed. You may think yours is right, but it is as flawed as mine when it comes to the common reality we all live in.

Thats why there is vigilante justice. The courts let the killer live, and the justice is served by someone else.

Your sense of "justice" is perverse.

There is nothing "just" about punishing someone who doesn't understand they did anything wrong.

Vigilantes, who are usually family or close friends or associates of the victims, are hardly impartial arbitrators. They can easily err and kill complete innocents.

If a perfect forthright citizen, maybe a virger at his church and volunteers at a food kitchen, kills his kids…………….we can all agree, right here on the Forum, that he must be insane. He is insane, kills kids, no argument.

Don’t respond ‘it’s the law’ because debates, such as this between a few people sitting at Starbucks, has to do with what that person thinks. I think the man should be executed and you will say, I guess, that you think he should not be executed. How can that be?

Massachusetts uses what's called the "McHoul Standard":

"In Massachusetts, the defense may apply when a person’s mental condition prevents them from understanding or controlling their actions at the time of an alleged crime, including during an episode of psychosis."
