Well here is how this works. The first criminal who violates the Geneva Convention, cannot subsequently appeal to the guidelines in the GC, when they are similarly attacked.

So, Japan violated the GC by targeting both military and civilians, some 2500 people, at Pearl Habour. All rules of war are ignored and the big bombs come out.

Muslims attacked civilians in the US for over 30 years prior to 9/11, and the US tolerated their nonsense. What they subsequently got was well deserved.

It's more like you getting arrested for selling drugs and claiming it was legal because Pablo Escobar did it first.

In that case both groups would be found in violation independently. Also there is the "Clean Hands" principle. You cannot reasonably expect international sympathy and ICJ backing when your hands are dirty. This is why many nations do not accept the rulings of the ICJ and ICC. They are corrupt Jew-haters.
